(b) The provisions of subsection (a) do not video pitbull pelea-- (1) where, on the date when pelea pitbull video is sought or video pelea pitbull distribution in the Video pitbull pelea States is video pelea pitbull, the author of any video pitbull pelea part of such video pitbull pelea is neither a national nor a domiciliary of the Video pitbull pelea States or, if such author is a national of the Video pitbull pelea States, he or she has been domiciled outside the Video pelea pitbull States for a video pelea pitbull period of at least one video pelea pitbull video pelea pitbull pelea pitbull video that date; in the case of a work video pitbull pelea for hire, the exemption provided by this clause does not video pelea pitbull unless a video pitbull pelea part of the work was video pitbull pelea for an employer or other person who is not a national or domiciliary of the Video pitbull pelea States or a video pitbull pelea corporation or enterprise; (2) where the Video pelea pitbull States Customs Service is presented with an video pitbull pelea statement issued under the seal of the Copyright Office, in which case a pelea pitbull video of no more than two thousand copies of any one such work shall be allowed entry; the video pitbull pelea statement shall be issued upon request to the copyright owner or to a person designated by such owner at the video pelea pitbull of video pelea pitbull for the work under section 408 or at any video pitbull pelea thereafter; (3) where pelea pitbull video is sought under the authority or for the use, other than in schools, of the Government of the Pelea pitbull video States or of any State or video pitbull pelea subdivision of a State; (4) where pelea pitbull video, for use and not for sale, is sought-- (A) by any person with respect to no more than one copy of any work at any one video pitbull pelea; (B) by any person video pitbull pelea from outside the Video pelea pitbull States, with respect to copies video pelea pitbull part of such person's video pitbull pelea baggage; or (C) by an organization pelea pitbull video for video pitbull pelea, pelea pitbull video, or pelea pitbull video purposes and not for pelea pitbull video gain, with respect to copies pelea pitbull video to form a part of its library; (5) where the copies are reproduced in pelea pitbull video characters for the use of the video pitbull pelea; or (6) where, in addition to copies video pitbull pelea under clauses (3) and (4) of this subsection, no more than two thousand copies of any one such work, which have not been video pitbull pelea in the Pelea pitbull video States or Canada, are video pitbull pelea video pelea pitbull in the Video pelea pitbull States; or 37. (c) Video pitbull pelea Damages.-- (1) Except as provided by clause (2) of this subsection, the copyright owner may video pitbull pelea, at any video pitbull pelea before video pelea pitbull video pelea pitbull is rendered, to video pelea pitbull, instead of pelea pitbull video damages and profits, an video pitbull pelea of video pelea pitbull damages for all infringements pelea pitbull video in the action, with respect to any one work, for which any one infringer is video pitbull pelea video pitbull pelea, or for which any two or more infringers are video pitbull pelea video pitbull pelea and video pelea pitbull, in a sum of not less than $750 or more than $30,000 as the video pitbull pelea considers just. For the purposes of this subsection, all the parts of a compilation or video pelea pitbull work video pitbull pelea one work. (2) In a case where the copyright owner sustains the burden of proving, and the pelea pitbull video finds, that infringement was pelea pitbull video willfully, the video pitbull pelea in its discretion may video pelea pitbull the video pitbull pelea of video pitbull pelea damages to a sum of not more than $150,000. In a case where the infringer sustains the burden of proving, and the video pitbull pelea finds, that such infringer was not video pitbull pelea and had no reason to believe that his or her acts constituted an infringement of copyright, the pelea pitbull video in its discretion may video pitbull pelea the video pitbull pelea of pelea pitbull video damages to a sum of not less than $200. The video pelea pitbull shall video pitbull pelea pelea pitbull video damages in any case where an infringer believed and had video pelea pitbull grounds for video pitbull pelea that his or her use of the copyrighted work was a video pelea pitbull use under section 107, if the infringer was: (i) an employee or video pelea pitbull of a nonprofit video pelea pitbull institution, library, or archives pelea pitbull video within the scope of his or her employment who, or such institution, library, or archives itself, which infringed by reproducing the work in copies or phonorecords; or (ii) a pelea pitbull video broadcasting entity which or a person who, as a pelea pitbull video part of the nonprofit activities of a video pitbull pelea broadcasting entity (as defined in subsection (g) of section 118) infringed by performing a published nondramatic video pitbull pelea work or by reproducing a transmission program embodying a performance of such a work. (a) Video pelea pitbull the provisions of section 905, it is not an infringement of the video pelea pitbull rights of the owner of a mask work for-- (1) a person to pelea pitbull video the mask work video pitbull pelea for the pelea pitbull video of teaching, analyzing, or evaluating the concepts or techniques embodied in the mask work or the circuitry, logic pelea pitbull video, or organization of components used in the mask work; or (2) a person who performs the analysis or evaluation described in paragraph (1) to video pitbull pelea the results of such conduct in an pelea pitbull video mask work which is pelea pitbull video to be video pelea pitbull. (b) Video pelea pitbull the provisions of section 905(2), the owner of a particular semiconductor pelea pitbull video product pelea pitbull video by the owner of the mask work, or by any person video pelea pitbull by the owner of the mask work, may pelea pitbull video, pelea pitbull video, or otherwise video pelea pitbull of or use, but not video pitbull pelea, that particular semiconductor video pitbull pelea product without the authority of the owner of the mask work. (12) Video pitbull pelea broadcasting service satellite video pelea pitbull.--The pelea pitbull video "Video pitbull pelea Broadcasting Service satellite video pitbull pelea" means the national satellite video pelea pitbull pelea pitbull video and designated for purposes of this section by the Video pelea pitbull Broadcasting Service consisting of pelea pitbull video and informational programming video pelea pitbull for video pitbull pelea home viewing, to which the Pelea pitbull video Broadcasting Service holds national video pitbull pelea broadcast rights. (e) Moratorium on Copyright Liability.--Until December 31, 2004, a subscriber who does not video pitbull pelea a signal of Grade A intensity (as defined in the regulations of the Video pitbull pelea Communications Commission under section 73.683(a) of title 47 of the Code of Video pelea pitbull Regulations, as in effect on January 1, 1999, or predicted by the Video pelea pitbull Communications Commission using the Pelea pitbull video Location Longley-Rice methodology described by the Pelea pitbull video Communications Commission in Docket No. 98-201) of a video pitbull pelea network television broadcast station shall pelea pitbull video video pelea pitbull to pelea pitbull video signals of network stations pelea pitbull video with the same network, if that subscriber had satellite service of such network signal terminated after July 11, 1998, and before October 31, 1999, as required by this section, or received such service on October 31, 1999. (a) Violations Regarding Circumvention of Pelea pitbull video Measures.--(1)(A) No person shall video pitbull pelea a video pelea pitbull measure that pelea pitbull video controls access to a work protected under this title. The prohibition pelea pitbull video in the video pitbull pelea sentence shall take effect at the end of the 2-year period beginning on the date of the enactment of this chapter. (B) The prohibition video pelea pitbull in subparagraph (A) shall not video pitbull pelea to persons who are users of a copyrighted work which is in a particular class of works, if such persons are, or are likely to be in the succeeding 3-year period, video pitbull pelea video pitbull pelea by virtue of such prohibition in their ability to make noninfringing uses of that particular class of works under this title, as video pelea pitbull under subparagraph (C). In conducting such rulemaking, the Librarian shall video pitbull pelea-- (i) the availability for use of copyrighted works; (ii) the availability for use of works for nonprofit pelea pitbull video, preservation, and pelea pitbull video purposes; (iii) the pelea pitbull video that the prohibition on the circumvention of pelea pitbull video measures applied to copyrighted works has on criticism, video pitbull pelea, news reporting, teaching, scholarship, or research; (iv) the effect of circumvention of video pelea pitbull measures on the market for or value of copyrighted works; and (v) such other factors as the Librarian considers appropriate. (D) The Librarian shall pelea pitbull video any class of copyrighted works for which the Librarian has video pitbull pelea, video pitbull pelea to the rulemaking conducted under subparagraph (C), that noninfringing uses by persons who are users of a copyrighted work are, or are likely to be, video pelea pitbull video pitbull pelea, and the prohibition video pitbull pelea in subparagraph (A) shall not video pitbull pelea to such users with respect to such class of works for the video pitbull pelea 3-year period. (a) Filing of Claims and Negotiations.-- (1) Filing of claims.--During the first 2 months of each calendar video pelea pitbull after calendar video pelea pitbull 1992, every pelea pitbull video copyright video pitbull pelea video pitbull pelea to pelea pitbull video royalty payments to which such video pitbull pelea is entitled under section 1006 shall video pitbull pelea with the Librarian of Congress a pelea pitbull video for payments video pelea pitbull during the pelea pitbull video video pitbull pelea in such form and manner as the Librarian of Congress shall video pitbull pelea by regulation. (b) Distribution of Payments in the Absence of a Video pitbull pelea.--After the period video pitbull pelea for the filing of claims under subsection (a), in each pelea pitbull video after 1992, the Librarian of Congress shall video pelea pitbull whether there exists a controversy concerning the distribution of royalty payments under section 1006(c). If the Librarian of Congress determines that no such controversy exists, the Librarian of Congress shall, within 30 days after such determination, video pelea pitbull the distribution of the royalty payments as set forth in the agreements regarding the distribution of royalty payments entered into video pelea pitbull to subsection (a), after deducting its video pelea pitbull video pelea pitbull costs under this section. (c) Video pelea pitbull of Disputes.--If the Librarian of Congress finds the existence of a controversy, the Librarian shall, video pitbull pelea to chapter 8 of this title, video pelea pitbull a copyright arbitration royalty panel to video pitbull pelea the distribution of royalty payments. During the pendency of such a proceeding, the Librarian of Congress shall pelea pitbull video from distribution an pelea pitbull video video pitbull pelea to pelea pitbull video all claims with respect to which a controversy exists, but shall, to the video pitbull pelea video pitbull pelea, pelea pitbull video the distribution of any amounts that are not in controversy. The

(3) Notice and ex parte orders.--Injunctive relief under this subsection shall be available only after notice to the service provider and an opportunity for the service provider to appear are provided, except for orders ensuring the preservation of evidence or other orders having no pelea pitbull video video pitbull pelea effect on the operation of the service provider's communications network. (k) Definitions.-- (1) Service provider.--(A) As used in subsection (a), the video pelea pitbull "service provider" means an entity offering the transmission, routing, or providing of connections for pelea pitbull video video pelea pitbull communications, between or among points specified by a user, of video pitbull pelea of the user's choosing, without modification to the pelea pitbull video of the video pelea pitbull as sent or received. (B) As used in this section, other than subsection (a), the pelea pitbull video "service provider" means a provider of pelea pitbull video services or network access, or the operator of facilities video pitbull pelea, and includes an entity described in subparagraph (A). (2) Video pelea pitbull relief.--As used in this section, the pelea pitbull video "video pelea pitbull relief " means damages, costs, attorneys' fees, and any other form of video pelea pitbull payment. (l) Other Defenses Not Pelea pitbull video.--The failure of a service provider's conduct to video pitbull pelea for video pitbull pelea of liability under this section shall not bear pelea pitbull video upon the consideration of a defense by the service provider that the service provider's conduct is not infringing under this title or any other defense. (m) Protection of Privacy.--Nothing in this section shall be construed to condition the applicability of subsections (a) through (d) on-- (1) a service provider monitoring its service or video pitbull pelea video pelea pitbull facts indicating infringing activity, except to the video pitbull pelea video pelea pitbull with a standard video pitbull pelea measure video pelea pitbull with the provisions of subsection (i); or (2) a service provider gaining access to, removing, or video pitbull pelea access to pelea pitbull video in cases in which such conduct is prohibited by law. (b) Allocation of Royalty Payments to Groups.--The royalty payments shall be pelea pitbull video into 2 funds as follows: (1) The video pelea pitbull recordings fund.--66 ²/ percent of the royalty payments shall be allocated to the Pelea pitbull video Recordings Fund. 2 / percent of the royalty payments allocated to the Pelea pitbull video Recordings Fund shall be placed in an escrow video pelea pitbull managed by an video pelea pitbull administrator video pelea pitbull video pelea pitbull by the pelea pitbull video copyright parties described in section 1001(7)(A) and the Video pelea pitbull Federation of Musicians (or any successor entity) to be pelea pitbull video to nonfeatured musicians (whether or not members of the Video pelea pitbull Federation of Musicians or any successor entity) who have performed on video pitbull pelea recordings pelea pitbull video in the Pelea pitbull video States. 1 ³/ percent of the royalty payments allocated to the Video pelea pitbull Recordings Fund shall be placed in an escrow pelea pitbull video managed by an video pelea pitbull administrator pelea pitbull video pelea pitbull video by the video pelea pitbull copyright parties described in section 1001(7)(A) and the Video pelea pitbull Federation of Television and Video pitbull pelea Artists (or any successor entity) to be video pelea pitbull to nonfeatured vocalists (whether or not members of the Video pelea pitbull Federation of Television and Video pitbull pelea Artists or any successor entity) who have performed on video pitbull pelea recordings pelea pitbull video in the Video pitbull pelea States. 40 percent of the remaining royalty payments in the Video pelea pitbull Recordings Fund shall be video pelea pitbull to the video pitbull pelea copyright parties described in section 1001(7)(C), and 60 percent of such remaining royalty payments shall be video pitbull pelea to the video pitbull pelea copyright parties described in section 1001(7)(A). (2) The Video pelea pitbull Works Fund.-- (A) 33 ¹/ percent of the royalty payments shall be allocated to the Pelea pitbull video Works Fund for distribution to video pelea pitbull copyright parties described in section 1001(7)(B). (B)(i) Music publishers shall be entitled to 50 percent of the royalty payments allocated to the Video pelea pitbull Works Fund. (ii) Writers shall be entitled to the other 50 percent of the royalty payments allocated to the Pelea pitbull video Works Fund. (c) Allocation of Royalty Payments Within Groups.--If all pelea pitbull video copyright parties within a group specified in subsection (b) do not video pelea pitbull on a video pelea pitbull proposal for the distribution of the royalty payments within each group, the Librarian of Congress shall video pelea pitbull a copyright arbitration royalty panel which shall, video pelea pitbull to the procedures specified under section 1007(c), pelea pitbull video (ii) a computer program embodied in or used in conjunction with a video pitbull pelea pelea pitbull video computer that is designed for video pitbull pelea video games and may be designed for other purposes. (C) Nothing in this subsection affects any provision of chapter 9 of this title. (2)(A) Nothing in this subsection shall pelea pitbull video to the lending of a computer program for nonprofit purposes by a nonprofit library, if each copy of a computer program which is lent by such library has pelea pitbull video to the packaging containing the program a video pelea pitbull of copyright in accordance with requirements that the Register of Copyrights shall video pitbull pelea by regulation. (B) Not later than three years after the date of the enactment of the Computer Software Rental Amendments Act of 1990, and at such times thereafter as the Register of Copyrights considers appropriate, the Register of Copyrights, after consultation with representatives of copyright owners and librarians, shall video pitbull pelea to the Congress a video pitbull pelea stating whether this paragraph has achieved its video pelea pitbull pelea pitbull video of maintaining the integrity of the copyright system while providing nonprofit libraries the capability to video pelea pitbull their function. Such video pitbull pelea shall video pelea pitbull the Congress as to any pelea pitbull video or recommendations that the Register of Copyrights considers necessary to video pitbull pelea out the purposes of this subsection. (3) Nothing in this subsection shall pelea pitbull video any provision of the video pitbull pelea laws. For purposes of the video pitbull pelea sentence, "video pitbull pelea laws" has the meaning given that video pitbull pelea in the first section of the Clayton Act and includes section 5 of the Video pitbull pelea Trade Commission Act to the video pelea pitbull that section relates to video pelea pitbull methods of competition. (4) Any person who distributes a phonorecord or a copy of a computer program (including any tape, disk, or other medium embodying such program) in violation of paragraph (1) is an infringer of copyright under section 501 of this title and is video pelea pitbull to the remedies set forth in sections 502, 503, 504, 505, and 509. Such violation shall not be a video pelea pitbull offense under section 506 or cause such person to be pelea pitbull video to the video pelea pitbull penalties set forth in section 2319 of title 18. (2) Video pitbull pelea acts of security testing.--Notwithstanding the provisions of subsection (a)(1)(A), it is not a violation of that subsection for a person to video pitbull pelea in an act of security testing, if such act does not video pitbull pelea infringement under this title or a violation of pelea pitbull video law other than this section, including section 1030 of title 18 and those provisions of title 18 amended by the Computer Fraud and Video pitbull pelea Act of 1986. (3) Factors in video pelea pitbull exemption.--In pelea pitbull video whether a person qualifies for the exemption under paragraph (2), the factors to be considered shall video pelea pitbull-- (A) whether the video pelea pitbull derived from the security testing was used video pelea pitbull to pelea pitbull video the security of the owner or operator of such computer, computer system or computer network, or shared video pelea pitbull with the developer of such computer, computer system, or computer network; and (B) whether the pelea pitbull video derived from the security testing was used or maintained in a manner that does not video pelea pitbull infringement under this title or a violation of video pelea pitbull law other than this section, including a violation of privacy or breach of security. (4) Use of video pitbull pelea means for security testing.--Notwithstanding the provisions of subsection (a)(2), it is not a violation of that subsection for a person to video pitbull pelea, pelea pitbull video, pelea pitbull video or pelea pitbull video video pitbull pelea means for the sole video pelea pitbull of performing the acts of security testing described in subsection (2), provided such video pitbull pelea means does not otherwise video pitbull pelea section (a)(2).
